What to do?"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">When such a<\/span> <span class=\"hps alt-edited\">situation occurs<\/span><span class=\"\">, legal proceedings<\/span> <span class=\"hps alt-edited\">can be<\/span> <span class=\"hps\">initiated to<\/span> <span class=\"hps\">decide the issue.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">Indeed,<\/span> <span class=\"hps alt-edited\">wether there is a<\/span> <span class=\"hps\">custody<\/span> <span class=\"hps\">judgment<\/span> <span class=\"hps\">or not<\/span>, whether they were <span class=\"hps\">married or<\/span> <span class=\"hps\">common-law partners<\/span><span class=\"\">, both parents<\/span> <span class=\"hps\">are<\/span> <span class=\"hps\">holders of parental<\/span> <span class=\"hps\">authority over<\/span> <span class=\"hps\">their children<\/span>, unless <span class=\"hps\">they<\/span> <span class=\"hps\">have<\/span> <span class=\"hps alt-edited\">been deprived of<\/span><\/span>. Note that even if a child is in the sole custody of one parent, the other parent, although he did not have physical custody of his child still has parental authority and should be consulted on all important matters regarding the child, including the choice of the school .<\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">It is then up<\/span> <span class=\"hps\">to both parents<\/span> <span class=\"hps alt-edited\">to jointly<\/span> <span class=\"hps\">exercise parental<\/span> <span class=\"hps\">authority over<\/span> <span class=\"hps\">children<\/span> <span class=\"hps\">and decide<\/span> <span class=\"hps\">in particular to<\/span> <span class=\"hps\">all matters of<\/span> <span class=\"hps\">importance<\/span> <span class=\"hps\">concerning religion<\/span>, education, <span class=\"hps\">health,<\/span> <span class=\"hps\">medical care,<\/span> <span class=\"hps\">welfare<\/span> <span class=\"hps\">being of children,<\/span> <span class=\"hps\">etc.<\/span><\/span> <span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">The parties must<\/span> <span class=\"hps\">in any case<\/span> <span class=\"hps\">consult and<\/span> <span class=\"hps\">decide together<\/span> <span class=\"hps alt-edited\">on the most appropriate<\/span> <span class=\"hps\">measures<\/span> <span class=\"hps\">depending on the circumstances<\/span>, and <span class=\"hps\">in the best<\/span> <span class=\"hps\">interest of the child<\/span><\/span>.<\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">However,<\/span> <span class=\"hps\">under<\/span> <span class=\"hps\">Article 604 of the<\/span> <span class=\"hps\">Civil Code of Qu\u00e9bec<\/span><\/span>, \u00abIn the case of difficulties relating to the exercise of parental authority, the person having parental authority may refer the matter to the court, which will decide in the interest of the child after fostering the conciliation of the parties\u00bb.<\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps\">Thus<\/span>, the issue of <span class=\"hps\">school choice<\/span> <span class=\"hps\">is<\/span> <span class=\"hps\">an important issue<\/span> <span class=\"hps\">and if the parents<\/span> <span class=\"hps\">do not agree<\/span>, <span class=\"hps alt-edited\">one or the other<\/span> <span class=\"hps\">parent<\/span> <span class=\"hps\">may apply<\/span> <span class=\"hps\">to the Superior Court<\/span> <span class=\"hps\">of Qu\u00e9bec in order<\/span> <span class=\"hps\">that a judge<\/span> <span class=\"hps\">decides<\/span> <span class=\"hps\">which school<\/span> <span class=\"hps\">the child<\/span> <span class=\"hps\">will be<\/span> <span class=\"hps\">registered<\/span>, <span class=\"hps\">and always<\/span> <span class=\"hps\">in the best interest<\/span> <span class=\"hps alt-edited\">of the latter<\/span><\/span>.<\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"hps alt-edited\">A child is<\/span> <span class=\"hps\">under the parental authority<\/span> <span class=\"hps\">of his parents<\/span> <span class=\"hps\">until his<\/span> <span class=\"hps\">majority,<\/span> <span class=\"hps\">18 in Quebec<\/span>, <span class=\"hps\">and decisions<\/span> <span class=\"hps\">concerning children<\/span> <span class=\"hps\">may be revised<\/span> <span class=\"hps\">at any time<\/span> <span class=\"hps\">by the Court,<\/span> <span class=\"hps\">if<\/span> <span class=\"hps\">the circumstances<\/span> <span class=\"hps alt-edited\">warrant it<\/span><\/span>.<\/p>\n<p style=\"text-align: justify;\">Text written by Me Virginie Damien<\/p>\n","protected":false},"excerpt":{"rendered":"<p>When such a situation occurs, legal proceedings can be initiated to decide the issue.
